Terms of Use (End User License Agreement)

These Terms of Use (“Terms”) are a legal agreement between you and Maryna Yankevych, a self-employed individual registered in Cyprus (“we”, “us”), governing your use of the Somiya mobile application (“App”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, as permitted by the Apple App Store Terms of Service, for your own and your family’s personal, non-commercial use.

2. Eligibility

You must be 18 or older to use the App.

3. Your account

You are responsible for keeping your login credentials secure and for activity under your account. Family members you invite can access shared family data according to their role (organizer, member, viewer).

4. Subscriptions, free trial and billing

The App offers auto-renewable subscriptions (“Premium”).

• Free trial. If a free trial is offered, it converts to a paid subscription automatically at the end of the trial period unless you cancel at least 24 hours before it ends.
• Auto-renewal. Your subscription renews automatically at the then-current price for the same period unless you cancel at least 24 hours before the end of the current period.
• Price changes. If the price of your subscription increases, you will be notified in advance and, where Apple’s rules require it, asked to agree before the new price applies to you.
• Billing. Payment is charged to your Apple ID account at confirmation of purchase and on each renewal.
• Managing and cancelling. You can manage or cancel your subscription in your Apple ID / App Store settings. Deleting your Somiya account does not cancel your Apple subscription.
• Refunds and EU right of withdrawal. Purchases are made through Apple; refunds — including the 14-day right of withdrawal available to EU consumers — are handled directly by Apple under Apple’s refund process.
• Current prices, periods and trial length are shown in the App before you purchase.

5. Acceptable use

You agree not to:

• use the App for any unlawful purpose or to store unlawful content;
• attempt to access other users’ data, breach security, or disrupt the service;
• reverse engineer, decompile or resell the App except where the law expressly permits.

6. Your content

You retain ownership of the content you add (events, tasks, lists, document details). You grant us only the limited rights needed to host, process and sync that content to provide the service to you and your family. Content you submit to the AI extraction feature (such as a document scan) is processed transiently to produce a draft and is not stored — see our Privacy Policy. You are responsible for the content you add and for having the right to add it.

7. AI features

The App’s AI features produce drafts that you must review and confirm. Extracted information may be inaccurate or incomplete — including document expiry dates, which you should always verify against the original document. We are not responsible for decisions you make based on unconfirmed AI output. Do not rely on the App for legal, medical, financial or safety-critical decisions.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we process personal data.

9. Service availability

We aim to keep the App available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features.

10. Disclaimers

To the maximum extent permitted by law, the App is provided “as is” and “as available” without warranties of any kind, express or implied. Nothing in these Terms limits any rights you have as a consumer that cannot be excluded under applicable law.

11. Limitation of liability

To the maximum extent permitted by law:

• we are not liable for indirect, incidental or consequential damages, or for loss of profits;
• our total aggregate liability for all claims arising out of or relating to the App is limited to the amounts you paid us for the App in the 12 months preceding the event giving rise to the claim, or €50, whichever is greater.

Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct. Mandatory consumer-protection rights in your country of residence remain unaffected.

12. Termination

You may stop using the App and delete your account at any time; before deleting, you can export your data in-app (Account → Privacy & data export). We may suspend or terminate your access if you materially breach these Terms; where reasonably possible, we will notify you first.

13. Apple-specific terms

This Section applies because you obtained the App through the Apple App Store:

1. These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content.
2. We, not Apple, are responsible for the App and for providing any maintenance and support for it. Apple has no obligation to provide maintenance or support. For support, contact hello@somiya.app.
3. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
4. Apple is not responsible for addressing any claims by you or a third party relating to the App, including product-liability, legal/regulatory, and consumer-protection claims.
5. Apple is not responsible for investigating, defending, settling or discharging any third-party claim that the App infringes intellectual property rights.
6. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist-supporting”, and that you are not on any U.S. Government prohibited-parties list.
7. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

14. Governing law

These Terms are governed by the laws of the Republic of Cyprus (the controller’s country of establishment), without prejudice to the mandatory consumer-protection rights of the country in which you reside.

15. Changes

We may update these Terms. If a change is material, we will notify you in-app or by email at least 30 days before it takes effect, and you may stop using the App and cancel your subscription before the change applies. Continued use after the effective date constitutes acceptance.

16. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. We may assign these Terms and the related rights and obligations as part of a transfer of the service to a legal entity through which it is operated (for example, a company we establish); your rights under these Terms and applicable law will not be reduced by such a transfer.
